Vietnam’s requirements for individuals investing in construction of housing with 2 storeys or more and less than 20 dwelling units

On July 31, 2024, the Minister of Construction of Vietnam promulgated Circular No. 05/2024/TT-BXD on guidelines on the Law on Housing, which contains requirements for the construction of private multi-storey and multi-unit apartment buildings.

According to the Circular, an individual investing in the construction of houses with 2 storeys or more and less than 20 dwelling units, with each storey accommodating dwelling units designed and built for lease, shall meet the following requirements:

- He/she shall have a construction permit enclosed with the design dossier, which specifies the total number of dwelling units and the number of dwelling units in each storey, the building area of each dwelling unit, the parking area, and the common use area of each storey and the housing.

In cases of eligibility for exemption from construction permits, before the housing construction, the individual shall send written notices to the People’s Committee of the commune, ward, or commune-level town (hereinafter referred to as “People’s Committee of commune”) where the housing construction takes place, specifying the information on the permissible number of storeys, the permissible number of dwelling units of each storey, the floor area of each dwelling unit, the total number of dwelling units, the parking area, and the common use area of each storey and the housing.

The individual shall comply with the construction permit or the written notice sent to the People’s Committee of the commune where the housing is located;

- He/she shall ensure the satisfaction of fire prevention and firefighting requirements according to fire prevention and firefighting laws,  fire safety requirements according to national standards on separate housing, traffic conditions for firefighting vehicles to perform firefighting tasks, and other requirements (if any) stipulated by the provincial People’s Committee.

- He/she complies with the Regulation on the Management and Use of Apartment Buildings regarding the management and operation of private multi-storey and multi-unit apartment buildings prescribed in Clause 1 Article 4 of Circular No. 05/2024/TT-BXD.
