According to the Decree, the regulations on forced landing applicable to aircraft violating Vietnam’s airspace and conditions of airports designated for landing in cases of forced landing are as follows:
- The enforcing aircraft shall approach the aircraft violating Vietnam’s airspace as follows:
+ The enforcing aircraft shall approach the violating aircraft from the rear left or right in conformity with the conditions for mobility and observation;
+ The enforcing aircraft shall set an appropriate speed and distance to ensure safety and emit signs, signals, and actions;
+ The enforcing aircraft shall ensure the pilots (flight crew) of the violating aircraft can receive signs, signals, and actions to request landing at the designated airport or aerodrome;
+ After the violating aircraft has safely landed at the designated airport or aerodrome, the enforcing aircraft shall exit the area or land under the order of the military flight commander.
- Conditions of a designated airport or aerodrome:
+ The airport or aerodrome is conformable in terms of technical conditions for ensuring the landing of violating aircraft;
+ The terrain of the aerodrome shall be suitable for circling and approaching the aerodrome for landing; violating aircraft have sufficient fuel to reach the designated aerodrome.
+ The aerodrome with civil aviation operations is prioritized for landing designation.
Article 5 of Decree No. 139/2024/ND-CP stipulates cases subject to forced landing at airports and aerodromes as follows:
- Aircraft flying in Vietnam's airspace are illegally interfered with.
- Aircraft violating Vietnam’s airspace refuse to comply with the actions of the aircraft of the People’s Military of Vietnam that are intercepting or accompanying such the violating aircraft.
